23 October 2017 the Ministry of Health of the Russian Federation approved the order No. 850N, introducing a complicated procedure for changing the legal sex in Russia. In addition to the reprehensible psychopathologizing of transgender people, this procedure seems unfair to us in regard to intersex people, so we decided to find out the Ministry's position on this issue. After the Ministry of Health approved a new complicated procedure for legal gender recognition in Russia, which, in addition to the reprehensible psychopathologizing of transgender people, seems unfair in terms of intersex people also, we decided to find out the Ministry's position on this issue. We asked the authorities why intersex people need to undergo psychiatric comissions, if the reason for the discrepancy between their passport sex and the biological sex is a mistake of third parties in completing the documents after they were born and what changes of this act are planned in the future. In its response, the Ministry of Health avoided answering our questions, disclaiming responsibility for their own decisions and just enlisting the existing legal regulation. Communication in an attempt to get official explanations continues.
19 January 2018
Today, the Ministry of Health of the Russian Federation published the act, regulating the form and the procedure for issuing documents necessary for legal gender recognition. Recall that on October 16, 2017, the Association of Russian Speaking Intersex people sent their views on the upcoming draft. We welcome the decision of the Ministry of Health to accept our recommendation to exclude the term of psychiatric supervision as a requirement for a legal gender recognition. Nevertheless, other requirements of the current version of the act, from our point of view, are superfluous. We call on the Ministry of Health to make appropriate amendments to simplify the procedure for legal gender recognition and to exclude the requirement for a psychiatric diagnosis in order to bring the act in line with the principle of self-determination of gender identity in documents enshrined in the The Yogyakarta Principles on the Application of Human Rights Law in relation to Sexual Orientation and Gender Identity.

This draft, in our opinion, in addition to shortcomings in terms of legal techniques, introduce a complicated procedure for changing documents, including a one and a half year observation from a psychiatrist and the requirement to pass a special commission of a psychiatrist, a psychologist and a sexologist, which is unnecessary for changing documents of intersex people.
